Messaging Policy

Cervan can text and email your customers on your behalf: appointment confirmations, “on my way” ETAs, estimates, invoices, payment links and review requests. This policy explains the rules. It is part of our Terms of Service.
1. You must have consent
You may only send messages to people who gave you permission to contact them: for example a customer who gave you their number when booking work. Never import purchased lists and never send marketing or promotional blasts through Cervan. Messages must relate to the job, document or payment at hand.
You are responsible for complying with applicable law, including the TCPA, CAN-SPAM and state messaging rules, and for honoring any opt-out you receive directly.
2. Opt-out and help
Every text we send includes opt-out language. A recipient can reply STOP to stop receiving texts, START to opt back in, and HELP for help and our support address. Opt-outs are applied automatically to that phone number and cannot be overridden from inside the app: the business owner simply sees that texting is blocked for that customer and can still email them. Email recipients can unsubscribe from non-essential email.
3. Message rates and allowances
Message and data rates may apply to recipients. Each Cervan plan includes a monthly text allowance: Free 5, Pro 500, Business 2,000. When the allowance is used up, texting pauses until the next cycle or until you upgrade. We never bill you for overages, and email stays unlimited. See the Fee Disclosure.
4. Delivery is not guaranteed
Messages travel through carriers and mailbox providers we do not control. Delivery, timing and filtering are outside our control, so do not rely on a text or email as the only notice for anything time-critical or safety-related.
5. Content rules
Do not use Cervan messaging for anything unlawful, misleading, harassing, or in a category carriers prohibit (for example loans, gambling, cannabis, adult content, debt collection without proper registration). We may suspend messaging on an account that violates these rules. See our Acceptable Use Policy.
6. Shared sending number
Texts are sent from a Cervan sending number shared across accounts. It is outbound only: recipients cannot text your business back on it, and replies other than keywords like STOP are not delivered to you. Because the number is shared, misuse by one account can affect delivery for everyone, so we enforce these rules strictly and may suspend messaging immediately, without notice, if an account creates carrier, regulatory or reputation risk.
7. Your responsibility and indemnity
You represent and warrant that, for every number you message through Cervan, you have obtained and can document the consent the law requires, that you are not using a purchased, rented, scraped or third-party list, and that you will honor every opt-out immediately, including ones made to you directly by phone, in person or by email.
You agree to defend, indemnify and hold Cervan harmless from any claim, penalty, fine, damage, loss or cost, including reasonable attorneys' fees, arising from messages sent from your account, including claims under the Telephone Consumer Protection Act, CAN-SPAM, state telemarketing or recording laws, and carrier or aggregator penalties. This is in addition to the indemnity in our Terms of Service.
Keep your own records of consent. Cervan does not collect, verify or store proof of consent on your behalf, and cannot defend a claim about a contact you added.
